These Terms and Conditions ("Terms") govern your use of OkuShift ("the Software"), a macOS application developed and published by:

By purchasing, downloading, installing, or using OkuShift, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Software.

2. License Grant

Upon valid purchase, we grant you a limited, non-exclusive, non-transferable license to:

• Install and use OkuShift on devices you own or control
• Use the Software for personal or commercial purposes
• Receive free updates to the Software

The license is perpetual (lifetime) and applies to the current version and all future updates of OkuShift.

3. Restrictions

You may not:

• Copy, modify, or distribute the Software except as expressly permitted
• Reverse engineer, decompile, or disassemble the Software
• Remove or alter any proprietary notices or labels
• Sublicense, rent, lease, or lend the Software to third parties
• Use the Software in any way that violates applicable laws or regulations
• Share, publish, or transfer your license key to others

4. Payment and Billing

All purchases of OkuShift are processed by Paddle.com, our Merchant of Record. By making a purchase, you also agree to Paddle's Buyer Terms.

Paddle handles:

• Payment processing and checkout
• VAT/sales tax collection where applicable
• Invoice generation
• Refund processing

Prices are displayed in your local currency where possible. Final prices include applicable taxes.

5. Free Trial

OkuShift offers a 7-day free trial with full functionality. No payment information is required to start the trial. After the trial period, a valid license is required to continue using the Software.

6. Refunds

We offer refunds in accordance with our Refund Policy. Please review the Refund Policy for complete details on eligibility and the refund process.

7. Intellectual Property

OkuShift, including its code, design, graphics, and documentation, is the intellectual property of Fran Hrženjak / Točka obrt za računalne i druge usluge. All rights not expressly granted in these Terms are reserved. The Software is protected by copyright and other intellectual property laws.

8. System Requirements

OkuShift requires:

• macOS 15.3 (Sequoia) or later
• A built-in or external webcam
• Camera permission granted to the application
• Accessibility permission granted to the application

9. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

We do not warrant that the Software will be error-free, uninterrupted, or meet your specific requirements. Gaze tracking accuracy may vary depending on lighting conditions, camera quality, and individual physical characteristics.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FRAN HRŽENJAK, TOČKA OBRT ZA RAČUNALNE I DRUGE USLUGE, OR ANY AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE.

Our total liability for any claims arising from or related to the Software shall not exceed the amount you paid for the Software.

11. Privacy

Your privacy is important to us. Please review our Privacy Policy for information about how we handle data. In summary: all camera processing happens locally on your device, and we do not collect, store, or transmit video or images.

12. Termination

Your license to use OkuShift is effective until terminated. We may terminate your license if you breach these Terms. Upon termination:

• You must cease all use of the Software
• You must delete all copies of the Software from your devices
• Sections 7, 9, 10, and 14 shall survive termination

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Software after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Croatia, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Zagreb, Croatia.
